2019 TVRCCNA Raffle - 1986 TVR 280i Series 2

Rumors have been floating around so some may have heard this but it’s true: thanks to a generous donation the Club will be raffling off what we understand to be the very first US Series II 280i (VIN number SA9DH28P3GB019100). The car is in good mechanical condition and has just under 60,000 miles on the odometer. It still wears its original Gipgloss Red exterior with black interior. Now for the important details:

  • The car will be raffled off at Out of the Woodwork 2019 on September 7, 2019 in Watkins Glen, NY. You do not need to be present at Woodwork to win (though it obviously would be more fun).
     
  • Raffle tickets will be $75 per ticket and can be purchased through the TVRCCNA website, in person at Out of the Woodwork, and possibly at some other East Coast British car shows this summer if we can find a way to get the car there. Please e-mail us if you need help purchasing raffle tickets or have further questions.
     
  • Raffle tickets purchased online will be virtual tickets, we will assign each online ticket a sequential physical ticket number at the start of Woodwork and in the order tickets were purchased. Officers involved in assigning tickets will not be participants in the raffle and your physical ticket number will be available on request starting 5 September 2019.
     
  • The winner can take delivery of the car at Watkins Glen after the TVRCCNA Banquet or can arrange to pick it up in Kintnersville, PA after the event. Car must be picked up by 31 October 2019 or a new winner will be drawn.

Below is a sample of photos, plenty more will be available on as we start cleaning up the car and getting it ready so bookmark this page and check back periodically. We’ve intentionally chosen to raffle this car off and made the tickets affordable because the goal of this isn’t to make a ton of money for the club. Rather, we want to publicize the marque and hopefully the low entry cost will encourage owners of other British cars, or even those who have never owned a British car, to look at TVRs so please spread the word in your other car clubs and online forums. Rules and Restrictions

By entering this raffle, entrants accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by the TVR Car Club North America for publicity purposes and in lists of prize winners to be published in its newsletter and announced on the TVRCCNA website. Other rules and regulations may apply. Please contact TVRCCNA if you have questions. TVRCCNA's interpretation and application of the rules and regulations shall be final.

By entering this raffle, each participant releases TVRCCNA, its directors, officers, and agents from any and all liability for injuries, losses or damages of any kind caused by participating in the raffle or winning any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold TVRCCNA harmless from any and all losses, damages, rights, claims and actions of any kind rising in connection with or as a result of participating in the raffle or the winner’s acceptance or use of any prize.

Tickets:
Tickets are $75 each. Only one eligible person may be entered in the raffle per ticket sold. If the name of more than one person is submitted with a ticket purchase, and that ticket is selected as a winning ticket, then the person named first will be deemed the holder of record of that ticket and declared the winner. Division of prize by a group purchasing a ticket in common shall be to the sole responsibility of the person named as the holder of record of that ticket, should that ticket be selected as a winner.

TVRCCNA reserves the right to reject any entry form that is submitted with payment that does not constitute “good funds”. All defective or physically altered entry forms will be immediately disqualified by TVRCCNA. Prior to the Grand Prize drawing, TVRCCNA will make a reasonable effort to notify the individual and/or entity that submits such an entry form or one which has been rejected because the payment did not clear that the entry has been rejected by attempting to make contact through the information provided at the time of submitting the purchase request. All online orders for tickets must be received and/or purchased by Wednesday September 4, 2019. TVRCCNA assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines.

A raffle participant's sole and exclusive remedy for TVRCCNA's breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall TVRCCNA, its directors, officers, agents or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.

How to Purchase:
An individual can purchase as many Raffle tickets as he or she may wish, subject to availability.

To purchase Raffle tickets: use the order form provided to purchase tickets online, visit the TVRCCNA booth in-person at the 2019 U.S. Vintage Grand Prix on September 7, 2019, or contact the TVRCCNA Vice President to make other arrangements. Any entry form submitted by means other than these three will be rejected. All entries must include payment by check or credit card unless purchased in-person at which point cash will be accepted. TVRCCNA reserves the right to reject any entry form that is submitted with payment that does not constitute "good funds". No refunds will be made unless the raffle is canceled due to unexpected accidental damage to the Grand Prize or a cancelation of the U.S. Grand Prix car show and/or associated Out of the Woodwork TVRCCNA National Gathering, in which case all tickets will be refunded. No other refunds are available except in the exclusive discretion of TVRCCNA. TVRCCNA assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines.

Selection of Winners:
The 2019 TVR Car Club of North America 280i Raffle drawing will be held on September 7, 2019, from all eligible Raffle tickets. Winners need not be present to win. The winner will be notified according to the contact information provided to TVRCCNA at the time of ticket purchase. Should the Grand Prize winner not claim their prize by 31 October 2019, the Grand Prize will be forfeited and another winner will be selected. In addition to the winner being posted on the TVRCCNA Raffle web site, the name of the winner may be obtained from TVRCCNA by sending a self-addressed, stamped envelope to TVRCCNA Raffle, c/o Tony Hess, 316 Kintner Rd, Kintnersville, PA, 18930-9725 within one week of the drawing.

In order to collect his or her prize, a Raffle ticket winner may be required to sign and deliver to TVRCCNA: (a) a sworn affidavit of eligibility in accordance with these Rules and applicable law, including without limitation that he or she is at least 18 years old at the time he or she purchased the winning Raffle ticket; (b) such written information as is required by any applicable tax and/or real estate laws, including without limitation his or her Social Security Number; (c) proof of identity in forms satisfactory to the TVRCCNA showing that the person claiming the prize is the same person who is named on the winning Raffle ticket.; and (d) proof of purchase for the winning Raffle ticket (e.g. online sales receipt or physical ticket stub). The Grand Prize winner may be required to submit a W-2G, Form 5754 or similar tax form (provided by TVRCCNA) for tax withholding purposes.

Winning Odds:
The odds of winning a prize will depend on the number of Raffle tickets sold. If 1,000 tickets are sold, the odds of winning the Grand Prize is 1 in 1,000. If fewer tickets are sold, the chance of winning the Grand Prize improves.

Eligibility:
Anyone 18 years of age or older at the time of the purchaser's Raffle ticket purchase may enter. Members of the TVRCCNA Board of Directors and immediate family members residing in the same household are excluded from participating and are not eligible to win a prize. All federal, state, and local laws and regulations apply. The Raffle is void where prohibited or restricted by law. An affidavit of eligibility may be required from prize winners.

Prizes:
The Grand Prize is a 1985 TVR 280i Series 2, Vehicle Identification Number SA9DH28P3GB019100. The winner is solely responsible for any and all state or local license, title, registration, taxes, or fees associated with the vehicle, as well as insurance (proof of which must be shown prior to delivery) and pickup or delivery costs from the U.S. Vintage Grand Prix or Kintnersville, PA depending on the date the car is picked up.

General Terms and Conditions:
The Car will be transferred to the Grand Prize winner “as is, where is, and with all faults”. TVRCCNA does not make or provide any representation, guarantee or warranty, expressed or implied, in connection with the Car and accepts no liability or responsibility regarding the construction or condition of the Car. TVRCCNA does not warrant that the Car is of mercantile quality or that it can be used for any particular purpose. No express warranties are given and no affirmation of TVRCCNA by words and/or actions will constitute a warranty.

At the time of closing, all federal and state income taxes and sales tax based on the value of the car, will be due from the winner. TVRCCNA makes no guarantee that the Internal Revenue Service (IRS) will accept that value of the car for the purpose of determining any income tax that may be due from the winner. TVRCCNA takes no responsibility for any tax liabilities. Consult your tax advisor.

ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE CONTRACT, OR THE BREACH THEREOF, SHALL BE SETTLED BY BINDING ARBITRATION AT THE DISCRETION OF THE TVR CAR CLUB NORTH AMERICA, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.

By purchasing a raffle ticket and choosing to participate in the raffle, each raffle participant acknowledges and agrees that TVRCCNA has the right, in its sole discretion, to elect not to proceed with the raffle for any reason whatsoever or for no reason, and in such event, a participant's sole and exclusive remedy shall be to receive a refund of the full price paid by such participant for each raffle ticket purchased, without interest.
